Copyright Statement
Crucita Matos, as the sole creator and artist, reserves the right to enter resulting images into art exhibits, display in her studio, print competitions and other publications, websites and places where her work may be featured. CLIENT grants the photographer permission to display selected images resulting from this assignment as an example of Studio Tela’s work for the purposes of window and showroom exhibit, advertising & marketing, promotion on the Internet, publication, instruction, professional competition and for inclusion in Studio Tela’s portfolio and photographer blog site. Client releases all claims to profits that may arise from use of images.
Signed Model Release for all subjects and Session Fee required at time of Contract Signing. The session fee is due at booking and is Non-Refundable.
$199 of the Signature Outdoor Session fee or In-Studio Session fee acts as a retainer and reserves the time and talent of the photographer, in certain instances the Studio location rental, gallery preparation for the pending images, the allocated digital images for the session selected, image file preparation and Online Proofing Gallery and Ordering Appointment. A Model Release for all subjects must be signed by the client ahead of the session for the session to occur. The Session Fee does not include finished portraits or additional digital files past the allotment for the type of session. Digital Files are $50 per Image - A Digital File does not imply transfer of copyright. Personal Use License applies. (see below)
Digital Files
Upon purchase of prints and/or products, the digital file for the printed image will be made available for download to you as the client only. These files offer quick loading on Computer Displays and Smart Products. Removal of watermarks or alteration of the images is considered an infringement of copyright.
Online Proofing Gallery
After your ordering appointment, you will receive your password protected Online Proofing Gallery. You will be able to view and select your favorites from the session as well as order prints and products. Your gallery will automatically expire after 60 days. Favorites will be archived for a period of 1 year. Images that are not favorites will be removed from our archives after 90 Days. A Gallery Restoration fee of $50 will apply in order to republish your session for future downloads, print or product orders.
Ordering Appointment (Optional but Included)
As soon as your images are ready (within 1-2 weeks), we will communicate with you by email to lookout for your Image Gallery and to schedule your ordering appointment. At this appointment, your selected digital files included with your session will be delivered. Additional image files purchased will be delivered digitally upon final payment.
Cancellation / Reschedule Policy
Should the need arise for you to cancel, your non-fundable paid session fee will be retained for a future rescheduled date. In the event weather does not permit either party to complete the session, the paid session will be retained for a rescheduled date.
Product Orders
To preserve the integrity and guarantee of the final product, any and all prints, products and reproductions of the resulting images are ordered through the online gallery are printed through the studio's designated Lab(s). Payment for Products and prints ordered through your online gallery store will be due upon placement of the order. Due to the custom nature of the work, full payment must be received at the time of order. Once the lab receives the order for fulfillment, it cannot be cancelled or intercepted and is deemed non-refundable. Portrait Products are custom produced and cannot be resold to another client. As such, all sales are final.
Exchanges
Studio Tela Portraiture agrees to process even exchanges within 30 days of delivery, should an issue arise due to order error or damage in shipping.
Turnaround Time
Please allow up to 3 weeks for delivery from the time of fully paid order. Custom Heirloom Products, such as Wall Art, Wooden Boxes, Books and Albums may take 4-6 weeks for completion and delivery - depending on the Country of Origin. You will be notified regarding any delays in shipping or production. Pricing is subject to change without notice, but will be grandfathered in at the time of payment and booking. Applicable Sales Tax and Shipping applies to all product orders.
Payment Options
For your convenience the studio has adopted contactless methods of payment. You also may arrange for payment in person.
Payment Plans
Payment plans are available for Product Orders placed at your Ordering Appointment. Upon final payment, the product order will be sent to the Lab for processing. Delivery ETA will be provided upon notification from the Lab.
Balances
All Balances due past their due date will accrue a late fee of 3.5% of the remaining balance on a monthly billing cycle and will be invoiced accordingly.
Non-Studio Camera Use In Session
Use of any other cameras or smart devices with cameras other than that of the photographer is prohibited during the session.
Limit of Liability
Crucita Matos, Studio Tela Portraiture, her representatives and/or employees will not be held liable for any injury incurred by you or your family, or any damage to your property during the photo session or while on studio premises. You agree to indemnify and hold harmless, Crucita Matos & Studio Tela Portraiture, her representatives or employees, from any dispute in the event you or any member of your family become injured during your session or while on the premises of the shoot.
Health or Catastrophic Events
You agree to hold the photographer and studio harmless in the event the photographer cannot complete the session due to health reasons or natural disaster. We will happily reschedule for a future date of your choosing. In the event the photographer can no longer service anyone due to health reasons or other catastrophic events, we will provide comparable service referrals for your session and refund you the totality of your session fee.
